Terms of Service

This is a general template written for a California-based business and how MedPocket AI works today — not legal advice, and it hasn't been reviewed by an attorney. Have qualified counsel review it before relying on it for a real launch.

1. Agreement to these terms

These Terms of Service ("Terms") govern your use of MedPocket AI's website, account, and "My Pocket" dashboard (the "Service"). By creating an account or using the Service, you agree to these Terms. If you don't agree, please don't use the Service.

2. What the Service is — and isn't

MedPocket AI is a consumer information and organization tool. It explains medical, lab, procedure, and insurance terminology in plain language, and helps you organize medications, appointments, and family health profiles. It does not diagnose, treat, or prescribe, and it is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of a qualified health provider with questions about a medical condition.

Not for emergencies. Do not use MedPocket AI in a medical emergency. Call your local emergency number or go to the nearest emergency room immediately.

AI-generated responses may be incomplete, out of date, or inaccurate. Review anything important with a qualified professional before acting on it.

3. Eligibility and accounts

You must be at least 18 years old to create an account. You agree to provide accurate registration information (including a working email and phone number) and to keep your password confidential. You're responsible for activity that happens under your account.

4. Plans and billing

The Free plan includes a limited number of voice interactions and appointment preparations per month, described on our Plans page. Plus and Family are paid subscription plans billed monthly through Stripe.

Subscriptions renew automatically each billing period until canceled. You can cancel anytime from your account's billing portal; your paid features remain available through the end of the period you already paid for. Fees are non-refundable except where required by law or stated otherwise at our discretion.

We may change plan pricing or features with advance notice. Continuing to use a paid plan after a price change takes effect means you accept the new price.

5. Your content

You retain ownership of the information you enter into MedPocket AI (medications, appointments, family profiles, documents, and questions). You grant us a limited license to process that content solely to provide and improve the Service, including sending it to our AI provider to generate responses, as described in our Privacy Policy.

You're responsible for what you submit. Don't upload content you don't have the right to share, or content that is unlawful, abusive, or infringes someone else's rights.

6. Acceptable use

You agree not to: use the Service for anyone else's medical care without their knowledge and consent where applicable; attempt to interfere with, disrupt, or gain unauthorized access to the Service; use the Service to generate content intended to harm others; or resell or sublicense access to the Service without our permission.

7. Disclaimer of warranties

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the Service will be uninterrupted, error-free, or that AI-generated content will be accurate or complete.

8. Limitation of liability

To the fullest extent permitted by law, MedPocket AI and its owners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim arose, or $100 if you're on the Free plan.

9. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or misuse the Service.

10. Governing law

These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-law principles. Any dispute arising from these Terms or the Service will be subject to the exclusive jurisdiction of the state and federal courts located in California.

11. Changes to these terms

We may update these Terms from time to time. If we make material changes, we'll update the "Last updated" date above. Continued use of the Service after changes means you accept the updated Terms.
